Representative Davis (D) Alabama: "Let me turn to the Alabama Case.  
The former Governor of Alabama who was indicted ....the US Attorney’s
office that prosecuted the case declined to investigate juror misconduct and
indeed sought to exclude the e-mails from even being heard in an
evidentiary hearing.  Here is the question:  Would you expect a US Attorney
office that had evidence of jury misconduct to investigate the misconduct or
exclude it from being heard at evidentiary hearing?  Which is the better
practice, Mr. Gonzalez? "

US Attorney  General Gonzalez: "As a general matter, the former. But I'm
not going to comment on this particular case without looking at the facts."
