1. How Deep Will Special Prosecutor's Inquiry

....Problems with the Bush Justice Department go way beyond the
nine U.S. attorneys who were fired. Several cases point to corruption
by Bush DOJ prosecutors who were not fired, particularly Alice Martin
and Leura Canary in the Don Siegelman case in Alabama and Dunn
Lampton in the Paul Minor case in Mississippi.
Will Dannehy's inquiry include a serious look at these prosecutors?
Could someone else wind up handling that aspect of the
investigation? Could this aspect of the case be ignored?

file final appeal briefs

....Defense lawyers wrote Monday that federal prosecutors did not
meet the legal standard established by the Supreme Court that
differentiates an illegal bribe from a legal campaign contribution. In a
1991 case involving a West Virginia politician, the Supreme Court
ruled campaign contributions could be prosecuted as bribes only
when the politician makes an "explicit promise" to sell some official
action in exchange for the contribution.
"Prosecutors must prove that the official promised, pledged to
undertook to take some official action in exchange for the
contribution," Siegelman's defense lawyers wrote.
Defense lawyers argued the judge should have dismissed the case or
at least more fully explained the standard in his instructions to the
jury. During the trial, jurors heard testimony from Siegelman's and
Scrushy's top aides, but no one witnessed the two men actually
discussing the contribution.
